This would most likely have to use 

destroot.violate_mtree      yes

somewhere in its portfile.

rEFIt is abandoned since ~2010, but there is an actively maintained fork of it, rEFInd. However, SIP being enabled by default in recent macOS versions complicates installation, such that either SIP must be disabled, or the rEFInd installation be done from a secondary/recovery OS.
